MENVITA CLINIC PIOTR ŚWINIARSKI sp.k. z siedzibą w Warszawie jako administrator przetwarza informacje, które na gruncie Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (dalej jako „RODO”), mają charakter danych osobowych.
MENVITA CLINIC PIOTR ŚWINIARSKI sp.k. with its registered office in Warsaw, as the controller, processes information which, on the basis of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (hereinafter the "GDPR"), has the nature of personal data.

W związku z powyższym, zgodnie z obowiązującymi przepisami dotyczącymi ochrony danych osobowych, jesteśmy zobowiązani podać informacje dotyczące przetwarzania danych osobowych, określone w art. 13 lub 14 RODO. Poniższa informacja uwzględnia główne aspekty związane z przetwarzaniem danych osobowych osób korzystających ze świadczeń medycznych w MENVITA CLINIC PIOTR ŚWINIARSKI sp.k. W świetle powyższego informujemy Państwa, iż:
Accordingly, in accordance with the applicable data protection legislation, we are obliged to provide the information on the processing of personal data set out in Art. 13 or 14 of the GDPR. The information below covers the main aspects related to the processing of personal data of persons using medical services at MENVITA CLINIC PIOTR ŚWINIARSKI sp.k. In light of the above, we inform you that:

3. Cele przetwarzania danych osobowych / Purposes of processing personal data
Państwa dane osobowe są lub mogą być przetwarzane przez Administratora w następujących celach / Your personal data is or may be processed by the Controller for the following purposes: 

1. ustalenia Państwa tożsamości przed udzieleniem świadczenia zdrowotnego Państwu lub Pacjentowi w imieniu i na rzecz którego Państwo występujecie m.in. rezerwacji terminu konsultacji (telefonicznie, osobiście w podmiocie leczniczym), przekazania informacji o przygotowaniu do konsultacji, przypomnienia/potwierdzenia terminu konsultacji, przekazania informacji o odwołaniu terminu konsultacji, działania profilaktyczne. Podstawa prawna: art. 6 ust. 1 lit c), art. 9 ust. 2 lit h) RODO, art. 25 pkt 1 ustawy z dnia 06.11.2008 r. o prawach pacjenta i Rzeczniku Praw Pacjenta (dalej: „ustawa o prawach pacjenta”) oraz § 10 ust. 1 pkt 2 Rozporządzenia Ministra Zdrowia z dnia 9 listopada 2015 r. w sprawie rodzajów, zakresu i wzorów dokumentacji medycznej oraz sposobu jej przetwarzania (dalej: rozporządzenie MZ). Dane będą przechowywane przez okres niezbędny do realizacji tych celów / to establish your identity prior to the provision of healthcare to you or to the patient on whose behalf and for whose benefit you are requesting it, e.g. booking a consultation appointment (by telephone, in person at the healthcare facility), providing information on preparation for the consultation, reminding/confirming a consultation appointment, providing information on cancellation of a consultation appointment, preventive actions. Legal basis: Art. 6 sec. 1(c), Art. 9 sec. 2(h) of the GDPR, Art. 25(1) of the Act of November 6, 2008 on patient's rights and the Patient's Rights Ombudsman (hereinafter: "Patients' Rights Act") and § 10 sec. 1(2) of the Regulation of the Minister of Health of 9 November 2015 on types, scope and models of medical records and the manner of their processing (hereinafter: MH Regulation). The data will be kept for the period necessary for these purposes;​​​​​​​ 
2. wykonywania działalności leczniczej, profilaktyki zdrowotnej, zarządzania systemami i usługami opieki zdrowotnej, systemami i usługami zabezpieczenia społecznego: przede wszystkim udzielenia świadczeń zdrowotnych (np. realizacja wizyty/badania, wystawienie skierowania/recepty), prowadzenie wymaganej przepisami dokumentacji medycznej, zapewnienie ciągłości leczenia, przekazywanie informacji podmiotom uprawnionym (np. Sanepid), wystawianie zaświadczeń lekarskich, weryfikacja uprawnień do uzyskiwania świadczeń opieki zdrowotnej. Dane osobowe zawarte w dokumentacji medycznej są przetwarzane, co do zasady przez okres 20 lat, licząc od końca roku kalendarzowego, w którym dokonano ostatniego wpisu, z wyjątkami przewidzianymi w art. 29 ust. 1 ustawy o prawach pacjenta. Podstawą prawną przetwarzania jest art. 6 ust. 1 lit. c) RODO w zw. z przepisami ustawy z 15.04.2011 r. o działalności leczniczej oraz ustawy o prawach pacjenta oraz rozporządzenie MZ. Podstawą przetwarzania danych w zakresie, jaki jest niezbędny dla ochrony żywotnych interesów pacjenta, może być również art. 6 ust. 1 lit. d) RODO. W zakresie, w jakim przetwarzane dane obejmują dane szczególnych kategorii, podstawą prawną przetwarzania danych jest art. 9 ust. 2 lit. h) i c) RODO; Informacji o aktualnych okresach przechowywania dokumentacji medycznej udzieli Państwu nasz personel / to perform medical activities, preventive health care, management of health care system and services, social security systems and services: primarily the provision of health care services (e.g. the execution of a visit/examination, issuing a referral/prescription), keeping medical records required by law, ensuring the continuity of treatment, providing information to authorised entities (e.g. the State Sanitary Inspectorate), issuing medical certificates, verifying eligibility for healthcare services. Personal data contained in medical records shall be processed, in principle, for a period of 20 years from the end of the calendar year in which the last entry was made, with the exceptions provided for in Art. 29 sec. 1 of the Patients' Rights Act. The legal basis for the data processing is Art. 6 sec. 1(c) of the GDPR in conjunction with the provisions of the Act of 15.04.2011 on therapeutic activities and the Patients' Rights Act and the MH Regulation. The legal basis for the processing of personal data is the necessity to protect the vital interests of the patient in accordance with Art. 6 sec. 1(d) of the GDPR. To the extent that the data processed include special categories of data, the legal basis for the processing is Art. 9 sec. 2(h) and (c) of the GDPR; Information on the current storage periods for medical records will be provided to you by our staff; 
3. realizacji Państwa praw jako Pacjentów/osób upoważnionych przez Pacjenta m.in. realizacja uprawnienia Pacjenta/osoby upoważnionej przez Pacjenta do dokumentacji medycznej, uzyskiwania informacji o stanie zdrowia. Podstawa prawna: art. 6 ust. 1 lit c), art. 9 ust. 3 RODO, art. 9 i 26 ust. 1 ustawy o prawach pacjenta. Okres przetwarzania danych w tym celu jest taki sam, jak okres przechowywania dokumentacji medycznej opisany w punkcie 2) powyżej. Dane dotyczące zdrowia przetwarzamy w celach, o których mowa w pkt. 1, 2, 3 powyżej oraz jeżeli wyrażą Państwo zgodę na kontakt telefoniczny, w celu zaproponowania i uzgodnienia terminu konsultacji lub innego świadczenia zdrowotnego / to exercise your rights as a Patient/authorised person of the Patient, e.g. the Patient's/authorised person's entitlement to access medical records, obtain health information. Legal basis: Art. 6 sec. 1(c), Art. 9 sec. 3 of the GDPR, Art. 9 and 26 sec. 1 of the Patients' Rights Act. The period of processing for this purpose is the same as the period of storage of medical records described in 2) above. We process health data for the purposes referred to in points 1, 2, 3 above and if you agree to be contacted by telephone, in order to propose and arrange an appointment for a consultation or other health service; 
4. zapewnienie odpowiedniego standardu opieki zdrowotnej oraz poprawa jakości świadczonych usług m.in. badanie satysfakcji Pacjentów np. w formie ankiet, dostosowanie naszej oferty zgodnie ze zgłoszonymi wnioskami, uwagami, zapewnienie właściwej i sprawnej organizacji naszej działalności. Podstawa prawna art. 6 ust. 1 lit. b) i c) i f) RODO. Przez czas niezbędny do realizacji ww. celu, nie dłużej niż 1 rok od wykonania na rzecz Państwa ostatniego świadczenia / to ensure an appropriate standard of healthcare and improve the quality of the services provided , e.g. through patient satisfaction surveys, e.g. in the form of questionnaires, adjusting our offer in accordance with requests, comments, ensuring proper and efficient organisation of our activities. Legal basis: Art. 6 sec. 1(b) and (c) and (f) of the GDPR. For the time necessary to fulfil the above purpose, not longer than 1 year after the last service was provided to you; 
5. podjęcia na Państwa żądanie działań zmierzających do zawarcia umowy z nami (m.in. w zakresie udzielania świadczeń zdrowotnych, przeprowadzenie konsultacji przed wykonaniem świadczenia medycznego) – przez czas potrzebny do zawarcia umowy, nie dłużej jednak niż rok od powzięcia uzasadnionego przekonania, że do zawarcia umowy nie dojdzie i nie dłużej niż w 2 lata od ich pozyskania (podstawa prawna: art. 6 ust. 1 b) RODO) / to take steps, at your request, to conclude a contract with us (e.g. with regard to the provision of health care services, consultations prior to the provision of medical services) - for the time required to conclude a contract, but no longer than one year from the time you reasonably believe that a contract will not be concluded, and no longer than two years from the time they were obtained (legal basis: Art. 6 sec. 1 b) of the GDPR); 
6. wykonania ciążących na nas obowiązków prawnych – przez czas istnienia takiego obowiązku i kolejne 3 miesiące (podstawa prawna: art. 6 ust. 1 c) i f) RODO, np.: a) wystawianie i przechowywanie faktur oraz dokumentów księgowych b) udzielanie odpowiedzi na reklamacje w terminie, formie przewidzianych przepisami c) udowodnienia należytego wykonania ciążących na Administratorze obowiązków w zakresie przetwarzania danych osobowych (np. przekazania niniejszej informacji) – przez czas, w którym administrator może ponieść konsekwencje prawne niewykonania obowiązku np. otrzymać karę finansową od urzędów państwowych – zasadniczo 5 lat od dnia naruszenia prawa albo wystąpienia skutków naruszenia prawa – (podstawa prawna: art. 6 ust. 1 f) RODO oraz art. 189g Kodeksu postępowania administracyjnego) / to comply with our legal obligations - for the duration of such obligation and a further 3 months (legal basis: Art. 6 sec. 1 c) and f) of the GDPR, e.g.: a) issuing and storing invoices and accounting documents b) responding to complaints in the time, form prescribed by law c) proving proper fulfilment of the obligations incumbent on the Controller with regard to the processing of personal data (e.g. provision of this information) - for the period of time during which the Controller may suffer legal consequences of non-fulfilment of the obligation e.g. receive a financial penalty from state authorities - in principle 5 years from the date of the breach of the law or the occurrence of the consequences of the breach of the law - (legal basis: Art. 6 sec. 1 f) of the GDPR and Art. 189g of the Code of Administrative Procedure); 
7. prowadzenia z Państwem korespondencji – w zakresie wynikającym z jej treści lub z nią związanej, zarówno w przypadkach, gdy występujecie w niej we własnym imieniu, jak i w imieniu osób trzecich – przez czas, w którym treść tej korespondencji ma znaczenie prawne dla nas, dla Państwa lub osób, w imieniu których Państwo występujecie / to conduct correspondence with you - to the extent that it arises out of or relates to the content of that correspondence, whether on your own behalf or on behalf of a third party - for as long as the content of that correspondence is of legal significance to us, to you or to the person on whose behalf you are acting; 
8. rekrutacja z wykorzystaniem formularzy lub wiadomości e-mail – celem przetwarzania danych (CV, listy motywacyjne, dodatkowe informacje) jest rozpatrzenie Twojej aplikacji w procesie rekrutacji. Podstawa prawna: RODO art. 6 ust. 1 lit. b (w przypadku będącej w toku rekrutacji) lub art. 6 ust. 1 lit. a (zgoda wyrażona w treści CV i listu motywacyjnego; jeśli chcesz, by Twoja aplikacja, była wykorzystana również w innych rekrutacjach, napisz o tym w klauzuli) / recruitment using forms or email messages – the purpose of processing the data (CVs, cover letters, additional information) is to consider your application in the recruitment process. Legal basis: GDPR Article 6(1)(b) (in the case of ongoing recruitment) or Article 6(1)(a) (consent expressed in the content of the CV and cover letter; if you wish for your application to be used in other recruitment processes as well, please mention this in the clause); 
9. marketing własnych usług i wysyłanie informacji handlowych dotyczących działalności Administratora – celem przetwarzania danych jest przesyłanie przez Administratora informacji handlowych dotyczących jego oferty oraz materiałów promocyjnych. Podstawa prawna: RODO art. 6 ust. 1 lit. a oraz f; / marketing of own services and sending commercial information related to the Administrator’s activities – the purpose of data processing is for the Administrator to send commercial information about their offer and promotional materials. Legal basis: GDPR Article 6(1)(a) and (f); 
10. wynikających z prawnie uzasadnionych interesów realizowanych przez Administratora lub stronę trzecią, a w szczególności w celu dochodzenia, ustalenia i obrony przed roszczeniami, zapewnienia bezpieczeństwa teleinformatycznego, w celach archiwalnych i statystycznych, jak również w celu analitycznym polegającym na analizie danych zbieranych automatycznie przy korzystaniu ze strony internetowej, w tym cookies np. cookies Google Analytics, Google Tag Manager, piksel Facebook, Microsoft Bing Ads, a także w celu profilowania dla potrzeb marketingowych, Podstawa prawna: RODO art. 6 ust. 1 lit. f. / arising from the legitimate interests pursued by the Administrator or a third party, in particular for the purpose of pursuing, establishing, and defending against claims, ensuring IT security, for archival and statistical purposes, as well as for analytical purposes involving the analysis of data automatically collected when using the website, including cookies such as Google Analytics cookies, Google Tag Manager, Facebook pixel, Microsoft Bing Ads, and also for profiling for marketing purposes. Legal basis: GDPR Article 6(1)(f). 
11. nieodpłatnego wykorzystania Pani/Pana wizerunku (utrwalonego za Pani/Pana zgodą i wiedzą) do celów marketingowych Administratora poprzez umieszczanie go w kanałach informacyjnych Menvita Clinic Piotr Świniarski sp.k. na stronie internetowej, na Facebook’u, w gazetkach informacyjnych, w prezentacjach multimedialnych, w materiałach edukacyjnych, filmach promocyjnych w ramach akcji promocyjnej – do czasu wycofania zgody lub ustania celu przetwarzania objętego zgodą. Podstawę do przetwarzania stanowi dobrowolna zgoda w rozumieniu art. 6 ust. 1 lit. a) RODO / free use of your image (recorded with your consent and knowledge) for marketing purposes of the Controller by placing it in information channels of Menvita Clinic Piotr Świniarski sp.k. on the website, on Facebook, in newsletters, in multimedia presentations, in educational materials, promotional films as part of a promotional campaign - until the time of withdrawal of consent or cessation of the purpose of processing covered by the consent. The basis for processing is voluntary consent within the meaning of Art. 6 sec. 1 (a) of the GDPR. 

W innych przypadkach Państwa dane osobowe przetwarzane będą wyłącznie na podstawie wcześniej udzielonej zgody w zakresie, celu i przez czas określonych w treści tej zgody. / In other cases, your personal data will only be processed on the basis of your previously given consent to the extent, purpose and for the duration specified in the content of that consent. 

4. Źródła pozyskiwania danych osobowych / Sources for obtaining personal data 

Dane osobowe, które posiada Administrator pochodzą przede wszystkim od Państwa. Jeśli dane nie zostały przekazane przez Państwa, mogą one pochodzić od innych podmiotów, z którymi Administrator współpracuje przy wypełnianiu celów statutowych.
The personal data held by the Controller comes primarily from you. If the data is not provided by you, it may come from other entities with which the Controller cooperates in fulfilling the statutory objectives. 

5. Okres przechowywania danych osobowych / Retention period of personal data 

Okres przechowywania Państwa danych osobowych jest uzależniony od podstawy prawnej ich przetwarzania / The retention period of your personal data depends on the legal basis for its processing: 

1. w przypadku, gdy dane stanowią dokumentację medyczną – okres przechowywania zgodnie z art. 29 ustawy o prawach pacjenta i Rzeczniku Praw Pacjenta wynosi 20 lat, z zastrzeżeniem wyjątków wskazanych w tym przepisie / In case where the data constitutes medical documentation – the retention period, in accordance with Article 29 of the Act on Patient Rights and the Patient Ombudsman, is 20 years, subject to the exceptions indicated in that provision; 
2. w przypadku, gdy dane są przetwarzane na podstawie art. 6 ust. 1 lit. c. RODO - dane osobowe zebrane w celu realizacji obowiązków wynikających z przepisów prawa, w tym prawa podatkowego będą przechowywane przez okres do wypełnienia tych obowiązków i przez okres wymagany przez przepisy prawa / In case where data is processed on the basis of Article 6(1)(c) of the GDPR – personal data collected for the purpose of fulfilling legal obligations, including tax law, will be stored until those obligations are fulfilled and for the period required by law;  
3. w przypadku, gdy dane przetwarzane są na podstawie art. 6 ust. 1 lit. b. RODO - dane osobowe przetwarzane będą do czasu zakończenia wszelkich czynności faktycznych i prawnych niezbędnych do realizacji umowy lub dla zabezpieczenia ewentualnych roszczeń / In case where data is processed on the basis of Article 6(1)(b) of the GDPR – personal data will be processed until the completion of all factual and legal actions necessary for the performance of the contract or for the protection of potential claims; 
4. w przypadku, gdy dane przetwarzane są na podstawie art. 6 ust. 1 lit. f. RODO - dane osobowe przetwarzane będą do czasu wypełnienia prawnie uzasadnionych interesów Administratora stanowiących podstawę tego przetwarzania lub do czasu wniesienia przez Państwa sprzeciwu wobec takiego przetwarzania / In case where data is processed on the basis of Article 6(1)(f) of the GDPR – personal data will be processed until the legitimate interests of the Administrator, which constitute the basis for such processing, are fulfilled or until you object to such processing; 
5. w przypadku, gdy dane przetwarzane są na podstawie art. 6 ust. 1 lit. a. RODO - dane osobowe przetwarzane będą do czasu wycofania przez Państwa zgody na ich przetwarzanie / In case where data is processed on the basis of Article 6(1)(a) of the GDPR – personal data will be processed until you withdraw your consent to its processing. 

6. Odbiorcy danych osobowych / Recipients of personal data 

Odbiorcami Państwa danych osobowych są lub mogą być: / The recipients of your personal data are or may be: 

1. upoważnieni pracownicy lub współpracownicy Administratora / authorised employees or associates of the Controller; 
2. podmioty współpracujące z Administratorem (podmioty lecznicze, ośrodki badawcze, osoby wykonujące zawody medyczne, inne fundacje) / entities cooperating with the Controller (medical entities, research centres, medical professionals, other foundations); 
3. instytucje państwowe, w przypadku jeżeli wymagają tego wiążące Administratora przepisy prawa / state institutions, where required by law binding on the Controller​​​​​​​; 
4. banki – w celu dokonania rozliczeń / banks - to make settlements; 
5. podmioty świadczące usługi pocztowe i kurierskie – w razie konieczności przesłania do Państwa korespondencji pocztowej / postal and courier service providers - if we need to send postal correspondence to you​​​​​​​; 
6. podmioty przetwarzające dane osobowe na zlecenie Administratora: podmioty świadczące usługi z zakresu księgowości, dostawcy usług IT, podmioty świadczące usługi wysyłki korespondencji elektronicznej, podmioty zajmujące się zarządzaniem bazami danych / entities processing personal data on behalf of the Controller: accounting service providers, IT service providers, electronic mail service providers, database management entities. 

7.Odbiorcy danych w Stanach Zjednoczonych Ameryki (USA) / Personal data recipients in the United States of America (USA) 

Z uwagi na korzystanie przez Administratora z usług Facebook, LinkedIn, Instagram, serwisu YouTube oraz Microsoft, Twoje dane osobowe mogą być przekazywane do Stanów Zjednoczonych Ameryki (USA). Portale wykorzystują zatwierdzone klauzule umowne lub stosują mechanizmy zabezpieczeń wskazane w RODO, w stosownych przypadkach, w zakresie przekazywania danych z Europejskiego Obszaru Gospodarczego do Stanów Zjednoczonych i pozostałych krajów. / Due to the Administrator’s use of services such as Facebook, LinkedIn, Instagram, YouTube platform and Microsoft, your personal data may be transferred to the United States of America (USA). These platforms use approved contractual clauses or apply the safeguards indicated in the GDPR, where applicable, in relation to the transfer of data from the European Economic Area to the United States and other countries. 

Administrator może korzystać również z usług Google, który utrzymuje serwery na całym świecie, wobec czego dane osobowe mogą być przetwarzane na serwerach znajdujących się poza Europejskim Obszarem Gospodarczym. Google stosuje mechanizmy zabezpieczeń przewidziane przez RODO. / The Administrator may also use services provided by Google, which maintains servers worldwide; therefore, personał data may be processed on servers located outside the European Economic Area. Google applies safeguards as required by the GDPR.

Administratorem danych osobowych na fanpage (profilu) na portalu społecznościowym Facebook, Instagram, platformie YouTube oraz LinkedIn jest MENVITA Clinic Piotr Świniarski spółka komandytowa / The administrator of personal data on the fanpage (profile) on the social media platforms Facebook, Instagram, and LinkedIn is MENVITA Clinic Piotr Świniarski limited partnership. 

Administrator przetwarza dane Użytkowników, którzy / The Administrator processes data of Users who: 

• dokonali subskrypcji na fanpage’u lub innym profilu na portalu społecznościowym poprzez kliknięcie ikony „Lubię to” lub „Obserwuj” / have subscribed to the fanpage or another profile on the social media platform by clicking the "Like" or "Follow" icon;

Administrator może przetwarzać następujące dane / The Administrator may process the following data: 

• podstawowe dane identyfikacyjne (imię i nazwisko) w zakresie opublikowanym przez Użytkowników na ich własnych profilach na portalu społecznościowym / basic identification data (first and last name) as published by Users on their own social media profiles; 

• dane opublikowane przez Użytkowników na profilu na portalu społecznościowym / data published by Users on the profile on the social media platform. 

Dane osobowe Użytkowników przetwarzane mogą być w następujących celach / Users' personal data may be processed for the following purposes: 

• prowadzenia profilu pod nazwą MENVITA – Andrology and Sexual Health Clinic (PL) – na portalu YouTube, w tym w celu administrowania i zarządzania profilem oraz komunikowania się z Użytkownikami, na warunkach oraz na zasadach określonych przez Google Ireland Limited, na podstawie art. 6 ust. 1 pkt a oraz f RODO / operating the profile under the name MENVITA – Andrology and Sexual Health Clinic (PL) on YouTube platform, including for the purpose of administering and managing the profile and communicating with Users, under the terms and conditions defined by Google Ireland limited, based on Article 6(1)(a) and (f) of the GDPR; 

• prowadzenia fanpage pod nazwą MENVITA CLINIC oraz MENVITA – Klinika Andrologii i Zdrowia Seksualnego – na portalu społecznościowym Facebook, w tym w celu administrowania i zarządzania fanpage oraz komunikowania się z Użytkownikami, na warunkach oraz na zasadach określonych przez Facebook Inc., na podstawie art. 6 ust. 1 pkt a oraz f RODO / operating the fanpage under the name MENVITA CLINIC and MENVITA – Andrology and Sexual Health Clinic on Facebook platform, including for the purpose of administering and managing the fanpage and communicating with Users, under the terms and conditions defined by Facebook Inc., based on Article 6(1)(a) and (f) of the GDPR; 

• prowadzenia profilu pod nazwą MENVITA CLINIC oraz MENVITA – Klinika Andrologii i Zdrowia Seksualnego na portalu społecznościowym Instagram, w tym w celu administrowania i zarządzania profilem oraz komunikowania się z Użytkownikami, na warunkach oraz na zasadach określonych przez Facebook Inc., na podstawie art. 6 ust. 1 pkt a oraz f RODO / operating the profile under the name MENVITA CLINIC and MENVITA – Andrology and Sexual Health Clinic on Instagram platform, including for the purpose of administering and managing the profile and communicating with Users, under the terms and conditions defined by Facebook Inc., based on Article 6(1)(a) and (f) of the GDPR; 

• prowadzenia profilu pod nazwą MENVITA CLINIC oraz MENVITA – Klinika Andrologii i Zdrowia Seksualnego na portalu społecznościowym LinkedIn, w tym w celu administrowania i zarządzania profilem oraz komunikowania się z Użytkownikami, na warunkach oraz na zasadach określonych przez LinkedIn Ireland Unlimited Company, na podstawie art. 6 ust. 1 pkt a oraz f RODO / operating the profile under the name MENVITA CLINIC and MENVITA – Andrology and Sexual Health Clinic on LinkedIn platform, including for the purpose of administering and managing the profile and communicating with Users, under the terms and conditions defined by LinkedIn Ireland Unlimited Company, based on Article 6(1)(a) and (f) of the GDPR; 

• ewentualnego ustalenia, dochodzenia lub obrony przed roszczeniami, na podstawie art. 6 ust. 1 pkt f RODO / potential establishment, exercise, or defense of legal claims, based on Article 6(1)(f) of the GDPR. 

Odbiorcą danych osobowych Użytkowników przetwarzanych w związku z działalnością na portalu społecznościowym mogą być / The recipients of Users’ personal data processed in connection with activity on social media platforms may include: 

• upoważnieni pracownicy Administratora danych / authorized employees of the Data Administrator; 

• podmioty związane z Administratorem umową o świadczenie usług w zakresie zapewnienia funkcjonowania fanpage’a lub innego profilu na portalu Facebook, Instagram, YouTube oraz LinkedIn / entities contracted by the Administrator to provide services related to the operation of the fanpage or other profiles on Facebook, Instagram, YouTube and LinkedIn; 

• właściciel portalu społecznościowego Facebook i Instagram w zakresie, jaki wynika z zapewnienia funkcjonowania fanpage’a na portalu Facebook i Instagram – zgodnie z regulaminem tego portalu / the owner of the Facebook and Instagram platforms, to the extent necessary for the functioning of the fanpage on Facebook and Instagram – in accordance with the terms and conditions of those platforms. 

• właściciel portalu społecznościowego LinkedIn w zakresie, jaki wynika z zapewnienia funkcjonowania profilu na portalu LinkedIn – zgodnie z regulaminem tego portalu / the owner of the LinkedIn platform, to the extent necessary for the functioning of the profile on LinkedIn – in accordance with the terms and conditions of that platform; 

• właściciel portalu społecznościowego YouTube w zakresie, jaki wynika z zapewnienia funkcjonowania konta na YouTube – zgodnie z regulaminem tego portalu / the owner of YouTube platform, to the extent necessary for the functioning of the profile on YouTube – in accordance with the terms and conditions of that platform. 

Dane Użytkowników zostały pozyskane od portalu Facebook, Instagram, LinkedIn, Twitter oraz z publicznych profili Użytkowników na wskazanych platformach internetowych / User data has been obtained from Facebook, Instagram, LinkedIn, and YouTube, as well as from Users’ public profiles on the mentioned online platforms. 

Dane osobowe Użytkowników będą przechowywane przez okres niezbędny ze względu na potrzeby biznesowe Administratora, przez okres prowadzenia fanpage (profilu) lub do czasu, aż Użytkownik zgłosi sprzeciw względem ich przetwarzania, cofnie zgodę – jeżeli dane przetwarzane były na podstawie zgody, lub Administrator sam stwierdzi, że dane zdezaktualizowały się / Users' personal data will be stored for a period necessary to meet the Administrator’s business needs, for the duration of maintaining the fanpage (profile), or until the User objects to the processing, withdraws consent – if the data was processed based on consent – or the Administrator determines that the data is outdated. 

Użytkownik posiada prawa wymienione w treści niniejszej Polityki prywatności / The User holds the rights outlined in this Privacy Policy. 

9. Prawo do wniesienia sprzeciwu wobec przetwarzania / Right to object to processing 

W zakresie w jakim Administrator przetwarza Państwa dane osobowe w oparciu o swój prawnie uzasadniony interes (art. 6 ust. 1 lit. f RODO), mogą Państwo w każdej chwili wnieść sprzeciw wobec takiego przetwarzania. Sprzeciw może zostać wniesiony w dowolnej formie, w tym na dane do kontaktu wskazane w ust. 2 powyżej.
To the extent that the Controller processes your personal data on the basis of its legitimate interest (Art. 6 sec. 1 (f) of the GDPR), you may object to such processing at any time. An objection may be lodged in any form, including to the contact details indicated in sec. 2 above.

Jeśli przetwarzanie odbywa się na podstawie zgody mogą Państwo ponadto w dowolnym momencie, bez podania przyczyny, cofnąć udzieloną zgodę, w dowolnej formie, w szczególności zaś wysyłając e-mail do Administratora danych. Cofnięcie zgody nie wpływa na zgodność z prawem przetwarzania, którego dokonano na podstawie zgody przed jej cofnięciem. Cofnięcie zgody jest równoznaczne z zaprzestaniem przetwarzania danych osobowych zebranych w oparciu o udzieloną zgodę.
If the processing is carried out on the basis of consent, you may furthermore withdraw your consent at any time, without giving reasons, in any form, in particular by sending an e-mail to the Data Controller. The withdrawal of consent does not affect the lawfulness of the processing carried out on the basis of consent before its withdrawal.
